Local Attorneys Weigh In On Fla. Lawyer's DUI Checkpoint Proposal
PITTSBURGH (KDKA) – Pittsburgh lawyers are weighing in on one attorney's recommendation for DUI checkpoints.
A Florida lawyer is suggesting drivers at DUI checkpoints don't roll down their windows and instead, just hold their license, registration and proof of insurance against the window, reports the Tribune-Review.
The lawyer, Warren Redlich, tells the paper making drivers roll down their windows is a violation of their fourth amendment rights.
But Pittsburgh lawyers tell the Trib they're not so sure that would fly here.
Attorney David Shrager tells the newspaper police will need to talk to you in order to determine your sobriety – and even if you legally don't have to roll down your window, it might not be the best thing to do.
Another lawyer with the ACLU in Pittsburgh says a court might say you have to roll down your window, according to the Trib.
The Pittsburgh lawyers appear to agree that making a fuss at a checkpoint might just cause more trouble for you.
