Jury Reviews Prior Testimony In Sandusky Trial
BELLEFONTE (KDKA) -- Jerry Sandusky's fate is in the hands of a Centre County jury. The former Penn State assistant football coach is charged with 48 counts of child sex abuse.
The Sandusky family, including Dottie, also arrived this morning to hear re-reading of the transcript of two key witnesses. The family came to court without Matt Sandusky who had been with them before, since he let it be known that he would have testified against his adoptive father.
The jury listened again to Mike McQueary's account of an encounter in the shower: "I saw in the mirror coach Sandusky behind a boy – his back right up against his front. The boy's hands were up against the wall… in the closest proximity. I was extremely alarmed, extremely flustered."
Then, they heard the testimony of defense witness, Dr. Jonathon Dranov about his conversation with McQueary that night: "Mike was visibly shaken and upset. He said a young boy looked around. I asked him if the boy seemed upset or frightened. He said no. He said the boy looked at him then someone pulled him away. When he looked again he saw Jerry Sandusky coming out of the shower."
The re-reading took about 90 minutes.
The jury took a lunch break around 12:15 p.m. and then resumed deliberations.
Friday afternoon, the jury wanted re-reading of the instruction regarding unknown Victim 8 in another shower incident that includes counts 36 through 40.
Judge Cleland told them the statement of the janitor who suffers from dementia and is unable to testify, cannot alone be enough to convict based on his hearsay testimony as related by another janitor.
"You must be satisfied that there is other evidence, either direct or circumstantial, to sustain a conviction on those counts," he told them.
The following is a breakdown of the counts the jury is considering:
- Six counts related to Victim 1, an 18-year-old
- Five counts related to Victim 2, who is unknown, the boy Mike McQueary saw in the shower at the Lasch Football building in 2001
- Four counts related to Victim 3, now 25 years old
- Five counts related to Victim 4, now 28 years old
- Four counts related to Victim 5, now 23 years old
- Four counts for Victim 6, now 25, whose case was first investigated in the late 90s but when nowhere
- Three counts involving Victim 7, now 27 years old
- Five counts for Victim 8 who is unknown
- Six counts for Victim 9 now an 18-year-old
- Six counts for Victim 10 now 25 years old
The jury is being sequestered during deliberations.
