A night of drinking
These bottles were found inside Caryn Kelley's home. Police determined a night of drinking was involved prior to the shooting in her bedroom on July 27, 2011.
Kelley arms herself
Caryn Kelley says she heard an intruder and immediately grabbed her loaded .38 caliber revolver from under the bed and removed it from the holster.
But the person Kelley thought was an "intruder" turned out to be her boyfriend, Phillip Peatross, who had returned to her home announced.
The couple had been arguing earlier that night about their relationship.

A night of drinking
Toxicology reports showed Phillip Peatross had a blood alcohol level of .11, which is over the legal limit in Florida.
