Rockland County Man Spared Prison Time For Sexually Abusing Boy, 14
NEW CITY, N.Y. (CBSNewYork/AP) -- A 59-year-old Rockland County man got to go home without serving time in prison, after admitting to sex acts on seven different occasions with a 14-year-old boy.
Moishe Turner of Monsey was sentenced to 10 years' probation Tuesday in Rockland County.
He pleaded guilty to second-degree criminal sex act on Jan. 18. The Journal News said the charge could have brought seven years in prison.
The incidents, which involved anal and oral sex, occurred in July 2011, the newspaper reported.
Prosecutors offered the non-jail plea agreement after the boy's family members said they wanted to spare him from testifying in open court. He had testified previously before the grand jury.
The lenient sentence came despite remarks by Rockland County Supreme Court Judge William Kelly indicating that Turner had blamed the boy for the sexual encounters, the Journal News reported.
The judge said Turner had characterized the boy as "sexually aggressive" and "wild," and had told probation officials that the boy had initiated sexual contact by backing his buttocks into Turner, the newspaper reported.
The judge classified Turner as a level 2 sex offender. That designation says there is a moderate chance of a repeat offense.
