Francesa Says 'Deflategate' Ruling Not Surprising; Legal Analyst Outlines Brady's Potential Next Moves
NEW YORK (WFAN) -- WFAN's Mike Francesa opened his show by saying an appeals court ruling Monday to reinstate Tom Brady's "Deflategate" suspension was not unexpected.

"If you paid attention a couple of weeks ago to what was said in the U.S. Circuit Court of Appeals, you got clearly the impression that they were going to overrule it," Francesa said.
"Remember, the lower court judge really surprisingly was not a big believer in the legal team that the NFL put in place, but that legal team has really one of the top reputations in the country, including especially the man who did the investigation and charged them a fortune for doing it. And he's a guy who is a very powerful legal figure. And clearly those judges felt differently about how that was handled and how he was handled."
Francesa then had WFAN legal analyst Steve Kallas on as a guest to ask him what Brady's recourse is.
"The first thing is going to be to apply to the 2nd Circuit for a rehearing," Kallas said.
"You have to show that there are exceptional circumstances here. It's a very hard thing. ... Unlikely."

If Brady is denied a rehearing, he can try to take the case to the Supreme Court.
"Tom Brady took such a scorched earth approach to this whole thing, I'd be surprised frankly if they don't at least try," Kallas said.
