Lawsuit To Move Forward Against 2 In Connection With Disappearance Of Lauren Spierer
INDIANAPOLIS (CBSNewYork/AP) - The lawsuit filed against two men by the parents of missing college student Lauren Spierer will move forward following a judge's decision Monday.
The Indiana University student disappeared on June 3, 2011 after a night out partying with friends in Bloomington, Ind.
Spierer's parents filed the lawsuit against former Indiana University students Jason Rosenbaum and Corey Rossman, claiming the pair gave the 20-year-old Westchester native alcohol, and then failed to make sure she made it back to her apartment safely.
U.S. District Judge Tanya Walton Pratt ruled that the parents can sue on counts alleging negligence and damages for providing drinks to someone who already was intoxicated.
Earlier this month, Pratt had thrown out a negligence lawsuit that Spierer's parents had filed against a third defendant, Michael Beth, ruling he was not liable for his actions in connection with the case.
The Spierers have long maintained that the men haven't fully cooperated with the investigation and hope the lawsuit will force them to answer questions under oath.
No one has been charged in Spierer's disappearance.
