Judge Tosses Weapons Charges Against Ex-Firefighter Accused Of Stalking Madonna
NEW YORK (CBSNewYork/AP) -- A Manhattan Supreme Court judge has dismissed weapons charges against the former firefighter who was arrested for harassing Madonna outside her apartment building two years ago.
Judge Analisa Torres ruled Wednesday that police improperly seized a gravity knife and ice pick from Robert Linhart when they arrested him in September 2010 outside Madonna's apartment on Central Park West, the New York Post reported.
Torres ruled that police seized the ice pick from Linhart's car-door pocket, and the gravity knife from a fanny pack he was not wearing, without a warrant, the Post reported.
Police said Linhart parked his sport-utility vehicle outside Madonna's building, laid out a tarp and began spray-painting poster boards with love notes.
One note read, "Madonna, I need you." Another read: "Tell me yes or no. If it's yes, my dream will come true. If it's no, I will go. XXX," the New York Post reported.
A resisting-arrest charge against Linhart is still pending.
