Judge To Hear Arguments In Suit Over Missing Westchester College Student
INDIANAPOLIS, Ind. (CBSNewYork/AP) – A federal judge will consider a motion to dismiss a lawsuit filed by the parents of a missing Indiana University student against three men who were with her the night she disappeared.
Judge Tanya Walton Pratt will hear arguments beginning at 2 p.m. at the federal courthouse in Indianapolis, Ind.
The lawsuit claims fellow IU students Corey Rossman, Michael Beth and Jason Rosenbaum, gave Lauren Spierer, of Edgemont, N.Y., alcohol, then failed to make sure the 20-year-old made it back to her apartment safely after a night of partying on June 3, 2011.
Spierer left without her shoes or cell phone and was later seen on surveillance video stumbling out of an elevator at her apartment. She was last seen wearing black pants and a white top.
Months of searches following her disappearance turned up nothing and so far, no arrests have been made.
The Bloomington Police Department said it has received more than 3,000 tips in the two years since Spierer went missing.
The apparel merchandising major would have graduated from Indiana University last spring.
Last year, the Spierers said they realize their daughter is likely dead, but said they will never give up trying to find her.
"We have no doubt that when Lauren is found, the next chapter of this horrible nightmare will begin anew," they said.
Defense lawyers for the young men maintain the Spierers have no evidence their daughter is dead and that they weren't responsible for the safety of an adult.
