Innocent Bystander Shot After Fight Inside Howard Beach Restaurant

NEW YORK (CBSNewYork) -- An innocent bystander was shot after a fight inside a Howard Beach restaurant Tuesday.
Police say around 7 p.m., two men got into a dispute at Frenasia Asian Bistro on Cross Bay Boulevard.
They say one man threw a chair at the other, and then the second man started shooting, hitting the bystander.
The victim was taken to the hospital but is expected to be OK.
Sources tell CBS2 the shooter is a retired NYPD officer. He was questioned and released without any charges.
The other man remains in custody with charges pending.
