In March, not long after she had gotten her driver's license, Brianna McEwan, now 17, was driving her car while at the same time checking a website on her iPhone.
She never saw 44-year-old Kenneth Dorsey jogging along Route 123 in New Canaan. He was struck and killed by her SUV.
Now, McEwan, charged with negligent homicide, is prepared to go to court this Friday. There, Prosecutor Suzanne Vieux said she'll likely receive a suspended sentence.
An agreement was worked out allowing the teen to avoid any prison time.
WCBS 880 Connecticut Bureau Chief Fran Schneidau reported that the Dorsey family is said to be very upset about this, according to their attorney. But he has not returned a call for further comment.
All court proceedings will be held behind closed doors as part of a youthful offender program which protects first-time teenage offenders from the glare of the public eye.
