DA: No Criminal Charges In Death Of Yonkers Student
YONKERS, N.Y. (CBSNewYork/AP) -- An investigation has determined that no criminal charges are warranted in the death of a teenager who was restrained at a school for troubled children.
The finding was issued Thursday by the office of Westchester County District Attorney Janet Difiore. It follows a July medical examiner's ruling that 16-year-old Corey Foster's death was an accident.
Foster died on April 18 at the Leake & Watts residential treatment center in Yonkers while being restrained by several staff members, police said.
The medical examiner said the 16-year-old suffered cardiac arrest "during an excited state while being subdued."
The DA's office said the three and half month probe, conducted with police and state investigators, included witness statements from about 55 staff members and residents. Authorities also analyzed surveillance video, medical records and the autopsy report.
"Based upon the analysis of all the information, we have concluded that no criminal charges are supported by the evidence in this case," Difiore said in a statement.
At least eight employees were suspended without pay after the incident.
The school educates students with severe emotional, mental and academic disabilities and many students live on campus.
