DA: Charges Dropped Against Jon Bon Jovi's Daughter Stephanie
NEW YORK (CBSNewYork) -- Charges have been dropped against Jon Bon Jovi's daughter, the Oneida County DA announced Thursday.
Stephanie Bongiovi, 19, had been facing drug charges, after allegedly overdosing on heroin at Hamilton College in upstate New York.
Bongiovi was hospitalized after she was found unresponsive Wednesday morning. Investigators also allegedly found heroin, marijuana, and drug paraphernalia in the dorm, which led to her arrest.
Bongiovi and another man, identified by authorities as 21-year-old of Ian S. Grant were charged on Wednesday. However, prosecutors dismissed the case Thursday because they said Grant called for help.
According to a press release from the DA's office, under New York law, a person can't be prosecuted for possession of small amounts of heroin if they're seeking help while overdosing.
Here Is The Law: "Under 220.78, subdivision 1, a person who, in good faith, seeks health care for someone who is experiencing a drug or alcohol overdose or other life threatening medical emergency cannot be prosecuted for the possession of heroin weighing less than 8 ounces or possession of any amount of marijuana resulting from the seeking of such health care. Additionally, under 220.78, subdivision 2, the individual who has overdosed or who was experiencing such life threatening medical emergency cannot be prosecuted for the possession of heroin weighing less than 8 ounces or possession of any amount of marijuana resulting from the seeking of such health care."
Bon Jovi's fans had well wishes for the family Wednesday night.
"He's a good dad, and seems to have a good mom and she's is going to be fine," Linda Pascale said.
"My impression is he is good guy and has finances for her to get her treatment," Lise Ring added.
There was no official comment from the singer or his representatives as they dealt with this family emergency.
Bon Jovi recently performed at a Hurricane Sandy benefit concert. He is scheduled to perform at a benefit concert for Hamilton in Times Square on Dec. 5.
