Court Upholds NY Law Requiring Individuals To Show 'Proper Cause' To Carry Handguns
NEW YORK (CBSNewYork/AP) -- A federal appeals court has upheld a New York law that requires applicants show a special need for self-protection in order to carry handguns.
The 2nd U.S. Circuit Court of Appeals in Manhattan issued its ruling on Tuesday.
The appeals court said the 2nd Amendment was not violated by the law requiring those who want to carry guns to show "proper cause."
The ruling was consistent with the findings of a lower-court judge.
A lawyer for five Westchester County residents who sought licenses said they were disappointed with the ruling.
Attorney Alan Gura said the New York case -- or a similar case in another state -- will likely be taken up by the Supreme Court.
New York Attorney General Eric Schneiderman called the ruling a major victory.
