Court Throws Out $7.7 Million Jury Award For PATH Station Fall
NEWARK, N.J. (CBSNewYork/AP) - An appeals court has tossed a $7.7 million jury award to a woman who slipped and fell in a PATH station six years ago.
Soma Mandal was on her way to work at a New York City hospital when she slipped on wet floor mats at the Pavonia station. She sued the Port Authority of New York and New Jersey and the Modern Facilities Services cleaning company.
The Port Authority was held 75 percent liable for the jury award.
But the appellate panel's Thursday ruling determined that the judge gave the jury incorrect instructions on the Port Authority's level of responsibility for accidents that occur in the station as opposed to getting on or off trains.
The appeals court says there should be a new trial.
