Lindsay Lohan Violated Probation? Judge Won't Consider SCRAM Bracelet Incident
BEVERLY HILLS, Calf. (CBS/AP) A modestly dressed Lindsey Lohan arrived at court Tuesday morning for proceedings that will determine whether or not the "Mean Girls" star will face jail time for allegedly violating her probation by not completing the required number of court ordered alcohol education courses.
Judge Marsha Revel demanded that Lohan's alcohol education program relinquish documents that could support prosecutor Danette Meyers claims of inadequate attendance.
But the troubled star is not only accused of playing hooky. Meyers said she has witnesses who can testify to claims that Lindsay was consuming alcohol after the MTV Movie Awards when her SCRAM bracelet reported signs of alcohol. Prosecutors claim the bracelet was later tampered with.
Lohan's attorney, Shawn Chapman Holley, said she was not prepared to challenge the bracelet's accuracy because the judge previously told her the report would not be considered at Tuesday's hearing.
Superior Court Judge Marsha Revel agreed with Holley, saying she was going to honor what she said in a closed session to lawyers for both sides, and not allow the negative report to be used at the hearing that could end with Lohan being sent to jail.
Lohan was required to wear the alcohol monitoring device after she missed a court date in May stemming from an Aug. 2007 incident, to which she pleaded no contest to two counts each of DUI and being under the influence of cocaine, in addition to a reckless driving charge.
Judge Revel will only consider whether the actress failed to complete the required number of alcohol education courses on time.
Lohan spent 84 minutes in jail in 2007 after she pleaded guilty to two misdemeanor counts of being under the influence of cocaine and no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving.
The plea came after a pair of high-profile arrests earlier that year. She was sentenced to three years of probation but had to ask for a yearlong extension in October after she failed to complete her alcohol-education courses on time.
Revel revoked Lohan's probation in May after the actress missed a court hearing to promote a film project at the Cannes Film Festival. Lohan claimed her passport was stolen, but Revel ordered her to wear the alcohol monitor upon her return.
Weeks later, the monitor issued an alert after Lohan attended the MTV Movie Awards and its after-parties.
Regardless of the outcome, Tuesday's hearing won't be the last reminder for Lohan of the court case and her arrests. She will soon be questioned about her drug use three years ago by civil attorneys representing a woman suing Lohan.
The actress' attorney persuaded a judge to delay that deposition until after Tuesday's hearing so her answers couldn't be used against her in the criminal case.
