Lady Gaga wins lawsuit against Lady Goo Goo

(CBS) It seems Lady Gaga isn't goo goo for anyone else trying to be Gaga.

The pop star won an injunction in London's High Court on Oct. 14 to stop the release of a Moshi Monster's single, "The Moshi Dance," sung by the character Lady Goo Goo, according to multiple newspaper reports. The Moshi Monster game, aimed at six to 12-year-olds, allows players to adopt "moshling" characters that often spoof real life musicians.

The court ruled that parent company Mind Candy could not participate in "promoting, advertising, selling, distributing or otherwise making available to the public 'The Moshi Dance' or any musical work or video which purports to be performed by a character by the name of Lady Goo Goo, or which otherwise uses the name Lady Goo Goo or any variant thereon," according to the official ruling.

The judge did allow Lady Goo Goo to continue existing -- she just couldn't have any of her trademark songs like "The Moshi Dance" and "Peppy-razzi."

According to the Guardian, Gaga claimed that her fans had become confused between the parody songs and her own productions. Mind Candy said in a statement obtained by the BBC that the ruling "a dangerous precedent" and "a huge disappointment," claiming there's no way fans would confuse the parodies with the real thing.

The company's chief executive Michael Acton Smith told the BBC, "It was a strange ruling - we certainly weren't expecting to lose." He thinks that they might have to kill off the character and  end her storylines within the game. "That's obviously not great for the kids who love her and love the music," he added.

This isn't the first company Lady Gaga has gone after for using her name or image. In September 2011, the singer filed a lawsuit against Excite Worldwide LLC for using her name on cosmetic and jewelry products without her permission.
