Wade's Ex-Wife Arrested Over Custody Incident
MIAMI (CBSMiami) – As the Miami Heat fight for its second NBA championship in six years, the attorney for Dwyane Wade was in a Chicago court asking for the visitation rights of Wade's ex-wife, Siovaughn Funches-Wade, to be suspended after she was arrested for two counts of attempted child abduction and unlawful visitation interference.
Wade's attorney, James Pritikin, filed the emergency motion and appeared in court Tuesday. Wade told the Associated Press his children have been with him since early Sunday morning and "that's what mattered most to me."
According to the filing, Wade's sons were supposed to be picked up by his sister around noon Saturday so they could make a 3:05 p.m. flight from Chicago to Miami. Wade's sister got no response at the home and after "several hours" the Cook County Sheriff's Office was notified.
The court filing from Wade's attorney said Funches-Wade tried to leave the home without the children when one of the deputies tried taking her into custody. The children were with another woman at the time of arrest named Nadgee Alarcon.
"I haven't done anything except for what I know is best for my children," Funches-Wade said in an interview with CBS station WBBM in Chicago. "I opened my gate after realizing a black car was sitting outside of my fence, and from there I was arrested."
She said the children saw it all happen.
"They saw what was happening and they were hysterical, crying uncontrollably," she said.
Wade hired a private jet to bring his son's home early Saturday morning to be with him for Father's Day. The court filing said Wade's older son told him that Alarcon "smacked him on the head" and was "cursing at him with abusive language."
Funches-Wade was charged with two counts of attempted child abduction, two counts of unlawful visitation interference and one count of resisting arrest. Alarcon was charged with one count of resisting arrest. All of the charges are misdemeanors.
"Once again, (she) has used the minor children as the proverbial pawns in this contentious dissolution of marriage action," Pritikin's filing said. "This court must take action to protect the minor children from further exposure to the present environment (she) creates while they are in her care and preventing (her) from exercising her parenting time in a manner that is harmful to the children."
Siovaughn Funches-Wade posted $10,000 bond on Monday and will return to court to face the charges in August. Records showed the Funches-Wade was taken to the hospital after the incident after telling officers she was experiencing shortness of breath and thought she was having an asthma attack.
For his part, Wade said the incident has not adversely affected his play in the NBA Finals.
Funches-Wade blames her legal troubles on Dwyane Wade and says she wouldn't be in this position if she had his money or fame.
"Because I've been too busy being a mother through all the hell me and my children have been through," she said.
