Sentencing Date Set For Coral Gables High School Stabber
MIAMI (CBS4) – Andy Rodriguez, the former Coral Gables High School student, who was convicted of second-degree murder in the stabbing death of classmate Juan Carlos Rivera is scheduled to be sentenced in November.
Attorneys for both parties met before Miami-Dade Circuit Court Judge Dava Tunis Wednesday and agreed to postpone his sentencing date to November 14th.
Defense attorney Alexander Michaels also asked a judge to issue an order limiting who is allowed to visit Rodriguez in jail.
On August 2nd, a jury convicted Rodriguez of second-degree murder which carries a maximum penalty of life in prison.
Rodriguez's defense claimed self-defense in the stabbing death of Rivera. Prosecutors countered that Rodriguez killed Rivera in a jealous rage after his ex-girlfriend, Daimilsis Salgado, befriended him.
"It was a hard decision to make. You have two mothers in pain, two young men and nobody is a winner," said juror foreperson Reva Homnick. "We all looked at the evidence and we came to the same conclusion. We all came together as a cohesive group, and we hugged at the end and felt we did the right thing."
