Scott Urges Fla. Justices To Reject Rule Challenge
TALLAHASSEE, Fla. (CBS4) -- Gov. Rick Scott has filed papers with the Florida Supreme Court urging the justices to reject a challenge to his takeover of agency rulemaking authority.
The written argument made public Friday says the Florida Constitution gives the governor all the authority he needs to suspend agency rulemaking powers.
Scott's lawyers, though, also argue it's premature to rule on those issues because the case should not have been filed with the Supreme Court.
They called it a "run-of-the-mill challenge" that should have gone first to a lower tribunal.
The case was filed by Rosalie Whiley, a blind food stamp applicant. Her lawyers contend Scott overstepped his authority by halting rules to simplify the food stamp reapplication process.
