Police ID 2 Robbers Shot During Home Invasion

MIAMI (CBS4) -- Miami-Dade police have identified the two men who were shot to death while they invaded a Palmetto Bay home on Thanksgiving eve.

CBS4 news partner The Miami Herald is reporting that Derrick Fussell, 28, and Gustavo Perez, 23 were shot by the intended victim, Antonio Luis Delpino, 27 as they entered his home uninvited.

The men burst into the apartment at 17255 SW 95th Ave. at about 10:20 p.m. Wednesday.

According to police spokesman Detective Roy Rutland, Delpino fired shots at two masked men. One man died at the scene. The second masked man jumped out of a third floor window and later died at Jackson Memorial Hospital.

The homeowner was not hurt and will not be charged. Under Florida's Stand Your Ground Law, a resident can presume the threat of bodily harm or death from anyone who breaks into a home, and is allowed to take defensive measures, including deadly force, against an intruder
