MIAMI (CBSMiami) – Police confirm a Kendall man has died from the gunshot wounds he sustained following an argument over a dog defecating in a yard.
Jose Rey had gone through multiple surgeries, according to family members.
Omar Rodriguez, 66, is accused of shooting Rey.
According to the police report, an argument began while Rey was walking his dog in the area of SW 97th Street and 103 Avenue, near Rodriguez's son's home, Saturday night around 9:30.
After the two men exchanged words regarding the dog, the police report states that Rodriguez noticed what appeared to be a shiny object in Rey's hand. Rodriguez grabbed a gun and fired at least two shots.
A witness told police Rey's wife ran to his side and Rodriguez threatened to shoot her too if she didn't leave him alone.
Neighbors told CBS4 Rodriguez doesn't live in the neighborhood, Rodriguez's son does, but people are familiar with him because Rodriguez calls the cops to place complaints against his neighbors all the time.
According to Miami-Dade Police, records show Rodriguez has called police more than 90 times.
Rodriguez, who was not injured during the argument, was transported to Kendall Regional Medical Center to be checked out. He was transported to Turner Guilford Knight Correctional Center after getting cleared by the hospital.
Rodriguez is charged with attempted second degree murder and aggravated assault with a deadly weapon. But those charges will most likely be upgraded soon.
