Key West Drug Testing Policy Ruled Unconstitutional
MIAMI (CBSMiami/AP) — A South Florida federal judge declared a policy by the city of Key West that requires drug tests for job applicants unconstitutional.
The American Civil Liberties Union of Florida said Monday the lawsuit was filed last year on behalf of Karen Cabanas Voss. She refused to submit to a drug test for a job as Key West recycling coordinator, leading the city to rescind the job offer.
U.S. District Judge James Lawrence King in Miami ruled the policy violates the U.S. Constitution's protection against unreasonable searches and seizures. Key West argued it could drug test job applicants but not employees.
The ACLU has won several similar decisions, including one invalidating an executive order by Gov. Rick Scott that would have subjected thousands of state workers to random drug testing.
