Deadly Dispute Outside SW Miami-Dade Supermarket

SOUTHWEST MIAMI-DADE (CBSMiami) -- A man was shot and killed after a dispute in a supermarket parking lot in Southwest Miami-Dade late Thursday night.

It all happened in the parking lot of a Winn-Dixie located on SW 104th Street and U.S. 1.

Police said 67-year old Juan Agriel and Eric Harris, 48, got into a verbal dispute. During the argument, police say Agriel pulled out a tire iron and tried to assault Harris who pulled out a gun and shot him.

Harris then called police and remained on the scene.

Agriel was taken to Kendall Regional Hospital where he died.

Police do not believe they knew each other.

Investigators said it seems to be self defense so there is no cause for an arrest at this time.

Harris is homeless and lives out of a car with a woman. Both were later taken into police custody but were returned a few hours later to pick up the car and a small dog which remained inside the car.

Eric Harris had little to say to the press when he came back to get his car.

"Bye have a nice day. Somebody just lost their life," said Harris.

Neighbor Ralph De Castro said he's seen Harris, this woman and their dog in the car here for the past week and a half.

"Their whole scenario. I think they had a dog with them, a lot of stuff in the car. It seemed like a homeless family. It just caught my attention," said De Castro.

He's disturbed this kind of violence happened in his neighborhood.

"There's crazy things happening everywhere. It's unfortunate it happened here. I'm glad it's not some kind of crazy guy going around shooting people," said De Castro.

Homicide detectives are continuing to investigate, and sat with the supermarket manager to look at surveillance video Friday morning.

The investigation will be handed over to the State Attorney's Office which will decide whether Harris will face charges.
