Charges Reduced For Woman Accused In Watercraft Shooting Death
MIAMI (CBS4) - A woman charged with murder in the shooting death of her boyfriend while the pair allegedly attempted to steal a personal watercraft has had her charges reduced, according to CBS4 news partners The Miami Herald.
Though she did not pull the trigger, Carolina Lopez, 19, was charged with 2nd degree murder of Reynaldo Munoz, 20, because his death occurred during the commission of a felony. Prosecutors decided Monday to instead charge Lopez with third degree grand theft for the incident on May 21. Under state law, anyone who commits certain felonies, such as burglary, can be held accountable for murder if someone dies during the commission of a crime.
According to police, Munoz climbed a concrete seawall and gained access to the occupied home on the 9200 block of North Bayshore Drive. Police said Munoz was apparently trying to steal a personal watercraft, which was in a lift at the home's dock.
A confrontation between Jack Davis, 14, who lived at the home, and Munoz ensued which led the Davis to shoot Munoz.
Munoz's body fell into the water, where it was recovered by police.
Prosecutors are still trying to determine whether Davis, the son of attorney Jeffrey Davis, was acting in self defense or committed a crime when he used the shotgun against Munoz.
Lopez reportedly confessed to police that she and Munoz had planned the theft, and that she dropped him of at the home.
