Man arrested in Miami Lakes gas station shooting
MIAMI LAKES - A man accused of shooting at two men in the parking lot of a Miami Lakes gas station, injuring one, has been denied bond.
Danny Casavilla-Garcia, 47, made his first court appearance on Tuesday morning and was ordered to stay away from the victims. He's facing two counts of attempted felony murder with a firearm.
The shooting happened early Monday morning in the parking area of a Shell station at Northwest 155 Street and Northwest 77th Court.
The shooting left one car with shattered windows and bullet holes in the wall of a nearby building and in a tree.
According to the arrest report, an intoxicated Casavilla-Garcia was taking pictures of cars parked in the area with his cellphone when he was approached by two of the owners, identified as Cedeno Alvarado and Angulo Moreno.
CBS News MIami obtained surveillance tape of the incident from a Pinch-a-Penny store where a store employee named Nicolas told us: "You see the suspect taking pictures of the victims' cars. This guy started acting weird and acting sporadic. You see him throwing himself on the ground and throwing his phone on the floor as well. And then you see him confronting them again and taking out his gun and actually firing at them."
CBS News Miami also spoke with Casavilla-Garcia's attorney Scott Eglesto,n who said his client may have a stand-your-ground defense. "He was not doing anything illegal," Egleston said. "He was not trying to get in to a vehicle. He was not trying the door knob. He was not trying the door handle. He was not trying to break a window. We have two guys confronting one guy, two guys assaulting and coming after my guy, Danny."
"We believe the facts will show that they got in the vehicle and came after him with a vehicle," he said. "In Florida we have no duty to retreat if we feel that our life is in danger. It is 3 o'clock in in the morning and two guys are slamming on their brakes. If you feel like your life is in danger you have every reason, every lawful reason to defense yourself. In the end we feel the facts will show that you can defend yourself if your life is threatened. And he purchased this firearm legally."
Both men confronted Casavilla-Garcia about what he was doing and told him to stay away from their cars.
Casavilla-Garcia then began arguing with the men and, at one point, pulled a gun and started shooting at them, according to police.
Alvarado, who was standing next to his vehicle, was hit in the pelvis. Moreno, who was sitting in his car, was not hit, but a bullet did shatter his driver-side window. There was also damage to the rear passenger door and window.
Alvarado ran into the gas station and called the police while hiding in the building. Meanwhile, Moreno drove off and also called the police. He then circled back to try and find Alvarado.
Arriving officers found Alvarado in the store. A short time later Moreno drove up.
According to police, Casavilla-Garcia called 911 and told the emergency operator that he was behind another building in the same parking lot. He was quickly taken into custody.
