Santa Ana Man, 32, Guilty Of Having Sex, Smoking Pot With Girl, 12
SANTA ANA (CBS) — A 32-year-old Santa Ana man pleaded guilty Friday to having sex and smoking pot with a 12-year-old girl.
Neftali Pena Procopio pleaded guilty to two felony counts of lewd acts on a child under 14 and a felony count of giving marijuana to a child, and admitted sentencing enhancement allegations for substantial sexual conduct with a child.
Procopio was arrested about 2 a.m., Aug. 17, in the 200 block of South Ross Street after he was found having sex with the girl in the back seat of his car, Santa Ana police Cpl. Anthony Bertagna said.
The two reportedly met Aug. 16 at Santa Ana High School, where they were playing in separate baseketball games, Bertagna said.
The two made plans to meet later that night. The minor snuck out of the house and the two had a long conversation before having sex, Bertagna said.
An officer driving by about 2 a.m. saw fogged up windows in the car and used condoms outside the vehicle. He then looked into the vehicle and saw the two naked in the back seat, Bertagna said.
Sentencing was scheduled for April 1. Procopio faces up to 11 years and eight months in prison.
