Man Sentenced To Life In Prison For 1984 Murder Of Supervisor
TORRANCE (AP) — A man convicted of the 1984 murder of his supervisor at a Los Angeles airport restaurant has been sentenced to life in prison without the possibility of parole.
City News Service says Torrance Superior Court Judge Mark Arnold gave the sentence Tuesday to Henry Earl Duncan.
Duncan had been sentenced to death in 1986 for the stabbing of Josephine Eileen DeBaun during a robbery at the restaurant where both worked.
But the 9th U.S. Circuit Court of Appeals ruled in 2008 that his attorney had failed to take advantage of evidence he may have had an accomplice, throwing out a special circumstances finding of murder in the course of a robbery and the death sentence.
Another jury found the allegation true again, but prosecutors did not seek the death penalty.
