Jury Rejects 'Zoloft Defense,' Finds Ex-Westminster Detective Guilty Of Kidnapping, Rape
ONTARIO (CBS) — A jury rejected the so-called "Zoloft defense" Wednesday and found a former Westminster police detective guilty of seven counts of kidnapping and rape.
A jury of eight women and four men needed just one night to reach guilty verdicts on all counts for Anthony Orban, a Marine veteran, who claimed the anti-depressant Zoloft made him kidnap a waitress from the Ontario Mills mall in April of 2010 and rape her in her SUV.
Orban was found guilty of two counts of rape, two counts of forced oral copulation, two counts of sexual penetration with a foreign object, one count of making a criminal threat and a sentence enhancement of using a firearm in the commission of a kidnapping. He will be subject to a sanity hearing before sentencing.
Orban's attorney claimed his client was unaware of the assault because of the medication, which he was taking because of post-traumatic stress following his deployment to Iraq.
Prosecutors say the attack happened after Orban spent a day drinking at the mall.
