Jury: Ex-Westminster Cop Claiming 'Zoloft Defense' Was Sane When He Kidnapped, Raped Woman
WESTMINSTER (CBS) — A jury has determined that a former Westminster police officer who claimed Zoloft impaired his judgment when he kidnapped and raped a woman in the Inland Empire to be sane.
Anthony Nicholas Orban, 32, pleaded not guilty to kidnap and rape by reason of insanity, but was convicted June 13 of kidnapping to commit rape, making criminal threats, forcible rape and oral copulation and sexual penetration.
Jurors deliberated for about two hours to decide whether Orban was insane at the time of the April 3, 2010 attack.
Orban, a veteran of the second Iraq war, was taking Zoloft to help with his post-traumatic stress syndrome. His attorney says the drug made him unaware of his actions the day of the attack.
Orban could now be sentenced to life in prison.
Sentencing is scheduled for Aug. 9.
