California Supreme Court Declines To Hear Bill Cosby's Legal Challenge To Judy Huth Suit
LOS ANGELES (CBSLA.com) — The California Supreme Court on Wednesday declined to hear Bill Cosby's legal challenge to a lawsuit filed by one of his accusers.
A petition by the comedian sought review of the lawsuit brought by Judy Huth, who claims Cosby sexually assaulted her in 1974 at the Playboy Mansion when she was 15.
The 78-year-old Cosby tried to block the case from moving forward, citing "procedural irregularities."
But on Wednesday, the High Court denied Cosby's petition seeking review of Huth's case.
Gloria Allred, Huth's attorney, says Cosby can now be deposed under oath.
She says she wants to depose him within 30 days, reported Claudia Peschiutta of KNX 1070 NEWSRADIO via Twitter.
"We believe we have a right to take his deposition in this civil lawsuit. We are going to tomorrow provide him with dates in August when we are available to do that. We are willing to even go to Massachusetts where allegedly he resides and take it," Allred said.
Peschiutta said there has been no comment from Cosby's attorney.
Huth's sexual battery lawsuit against Cosby comes amid other allegations, according to the Associated Press, by more than two dozen women.
Cosby has never been charged with a crime.
