School Janitor Arrested On Indecency With A Child Charges
DENTON (CBSDFW.COM) - A North Texas middle school janitor is behind bars today charged with Indecency with a Child/Sexual Contact.
Ambrocio Mata was arrested on November 1. Police say Mata, who turned 62-years-old today, had inappropriate sexual contact with a 12-year-old male student on the campus of Calhoun Middle School, in the Denton Independent School District.
According to an arrest affidavit, a school administrator contacted the campus police officer to inform him that a female custodian at Calhoun had seen a student locked in the custodian's closet with Mata on October 22. One week after that incident, a male custodian at Calhoun contacted the campus officer after finding Mata and a student in a classroom alone, after school.
The custodian said Mata and the student had been standing very close to each other before realizing he was in the room. When he saw the other custodian, the student ran away from Mata and across the room. The student said he was in the room to meet a teacher and Mr. Mata claimed he didn't know the child and had only approached him to ask a question. The classroom where the two were found was for 8th grade students; the child found in the room was a 7th grade student.
The janitor who found the two alone took the boy to the office of the campus officer. While there the boy became very upset, but continued to claim he was in the room to meet a teacher for tutoring. The child was then asked about the incident in the custodian's closet. Initially the boy denied knowledge of anything, but then said he had helped a woman put a bucket in the closet and that is when Mr. Mata got very close to him and made him feel uncomfortable.
The arrest affidavit states that given the events over that past week, school officials examined school surveillance video from October 22. They saw several disturbing incidents, including Mata and the student hugging and kissing in a stairwell, what appeared to be a near sodomy act and Mata and the student eventually leaving the stairs and going to the custodian's closet. The video also showed that three minutes after entering the closet another custodian unlocked the door and found Mata with the student, who ran from the closet and went to class.
When interviewed by a representative from the Child Advocacy Center for Denton County the student said there was a "creepy" janitor at the school that made him feel uncomfortable. After being shown the surveillance from the school stairwell the student said the janitor had threatened him.
Denton police arrested Ambrocio Mata at his home and district officials said he was immediately terminated. A statement issued by the district said, in part, "Denton ISD officials are working closely with Denton police to thoroughly investigate this incident and will continue to respond in a way that protects the safety and security of all students." A letter was sent home informing parents of the arrest.
Mata has a past criminal history that includes three Driving While Intoxicated charges, charges for illegal dumping and prosecution for the unlawful carrying of a weapon.
Mata was transferred from the Denton Police Department to the Denton County Jail on November 4. He is being held there on $250,000 bond.
