"The grand jury has made clear that our community won't tolerate unnecessary violence by anyone, including police officers," Harris County District Attorney Kim Ogg said in a statement.

The nine-year Baytown Police Department veteran is accused of confronting two men who had witnessed, made comments and took cellphone video of a June 2 traffic stop he made at a convenience store.

The driver was arrested during the traffic stop.

The video showed Brown throwing witness Skylar Gilmore, 24, to the ground and then using his knee to hit him in the shoulder and face.

Gilmore and the other witness, 23-year-old Isaiah Phillips, were arrested for disorderly conduct-language for using profanities while watching the arrest. Gilmore was also charged with interfering with public duties.

Ogg's office later dropped the charges against the two men.
