No Charges In Mich. Man's Shooting Death In Colo.
GOLDEN, Colo. (AP) - No charges will be filed against a Colorado sheriff's deputy and his prosecutor wife after they shot an intruder who died from his wounds, authorities said Thursday.
John and Heather Stein, of Hot Sulphur Springs, both shot Joshua Stevens outside their home on April 1 after Stevens forced his way into the home and fought with John Stein, officials said.
Stevens, 32, was from Coral, Mich., and was reportedly in Hot Sulphur Springs looking for work. Authorities said he did not know the Steins.
John Stein is a Grand County Sheriff's lieutenant and Heather Stein is chief deputy district attorney for the 14th Judicial District, which includes Grand County.
Peter Weir, district attorney for Jefferson County, reviewed the investigation at the request of the district attorney for Grand County. Weir concluded the Steins acted in self-defense and did not commit a crime.
Authorities said the Steins and three of their four children were asleep at their home, a former hotel building, when Stevens pounded on their door shortly before midnight.
John Stein retrieved a gun and opened the door. Stevens force his way in and began struggling with John Stein until he forced Stevens out of the home, according to authorities.
Stevens then approached a woman outside the home, and he and John Stein struggled again, with Stevens trying to take Stein's gun, authorities said.
Heather Stein, who also had a gun, attempted to help her husband. Authorities said John Stein shot Stevens three times and Heather Stein shot Stevens once.
An autopsy determined the shots fired by John Stein were fatal. The autopsy also determined Stevens had amphetamine, methamphetamine and other drugs in his system.
