Jury Selection Begins For Trial Of Man Accused In Road Rage Killing
HOWELL (CBS DETROIT/AP) - Jury selection starts Monday in the trial of a man accused of committing murder in a road rage incident near Howell.
Martin Zale, 69, is accused of shooting Derek Flemming in Livingston County, 45 miles northwest of Detroit.
Prosecutors say Flemming, 43, was shot in the head in Sept. 2 after getting out of his vehicle to ask Zale about his aggressive driving.
Witnesses, including Flemming's widow, Amy Flemming, told police Flemming wasn't armed when he approached Zale's truck and didn't make any verbal threats.
Flemming's wife says Zale was cutting them off and driving aggressively.
Records show both Zale and Flemming had been involved in prior road rage incidents.
The defense will try to show that Flemming was the person with a reputation for being aggressive.
