Judge To Decide Fate Of Former Nazi Policeman

A judge says she will decide within 90 days whether to deport an 89-year-old Michigan man who served in a Nazi-controlled police force during World War II.

The government alleges John Kalymon fired his gun and killed a Jew in 1942, when Jews were rounded up and removed from what is now Lviv, Ukraine.

Immigration Judge Elizabeth Hacker on Wednesday declined a request by Kalymon's lawyer to hold a mental competency hearing.

Kalymon served in the Nazi-sponsored Ukrainian Auxiliary Police in a region that was part of Poland until the Soviet Union and Germany invaded in 1939.

Kalymon, who lives in Troy, has denied shooting Jews. His lawyer has described the police unit as a group with little authority, and said Kalymon suffers from dementia.

Kalymon said he has prostate cancer.
