Case Dismissed Against Ohio Man In Crash That Injured Mich. Trooper
LANSING (WWJ/AP) - A judge has dismissed a criminal case against an Ohio man who authorities say lost control of his car and struck a Michigan State Police trooper in 2011.
Ingham County Circuit Court Judge Rosemarie Aquilina granted a motion Thursday by Mark Kollar's lawyer to dismiss the case. The 51-year-old from Eastlake, Ohio was charged with failing to use care while passing a police vehicle causing injury.
Police say Kollar struck Drew Spencer after the trooper stopped another motorist Sept. 4, 2011, on I-96 near Webberville in Ingham County. Spencer was critically injured in the incident, and was hospitalized for three weeks with a traumatic brain injury and other medical problems.
Kollar, who also faced a misdemeanor charge, said it was "purely an accident" and he has "grieved over it the past two years." His lawyer argued a lack of evidence.
Prosecutors will decide later whether to appeal.
