Humane Society Investigates Dog Shooting

COLORADO SPRINGS, Colo. (CBS4)- Police in Colorado Springs don't plan to file charges against a man who shot and killed a dog.

The man who fired shots said a mastiff attacked his greyhound while they were taking a walk on Wednesday. He said he was just protecting his property.

Police haven't released the greyhound owner's name.

Tammira Martinez was walking her dog, Plato, a bull mastiff, when she spotted a man walking his greyhound across the street.

"His dog was on an extended leash and his dog came after my dog," said Martinez.

She said when he took off running toward the other dog, she couldn't hang on to him. The mastiff reportedly bit the greyhound and Martinez said she ran across the street to grab her dog.

"As I went to grab down and get the leash is when I heard two shots," said Martinez.

The owner of the greyhound has a concealed weapons permit. There will be no charges as recommended by police.

"City ordinance does allow for the discharging of a fire arm in the city limits to protect yourself, your property or domestic animals," said a Colorado Springs Police Sergeant Noblitt.

"There was no reason to shoot my dog. My dog's a bull mastiff, and if he wanted to hurt the dog he would have done it in the first bite," said Martinez.

The Humane Society has issued a citation of unlawful ownership of a dangerous dog to Martinez.
