Suit: Woman Sexually Assaulted At Oak Park Bed And Breakfast
CHICAGO (STMW) - A negligence lawsuit was filed Tuesday claiming that a woman was beaten and sexually assaulted in her room at an Oak Park bed and breakfast by a person who entered the building through an open security door.
Linda and Wayne Mallory claims that Linda was a guest June 29, 2005, at the Harvey House Bed & Breakfast, 107 S. Scoville Ave in Oak Park when innkeeper Beth Harvey failed to close an exterior security door when she went outside to water the flowers and grass that morning, according to a suit filed in Cook County Circuit Court.
The suit claims that a person entered the building through the open security door, entered Linda's guest room and sexually assaulted her.
Linda suffered physical injuries and mental anguish, including post-traumatic stress disorder, according to the suit. She has also suffered a loss in normal intimacy and sexual relations with her husband.
The suit claims that the Harvey House failed to provide guest room doors with self-locking devices, dead bolt and chain locks or peep holes. The Harvey House also failed to have a surveillance system to protect guests from unauthorized people entering the guest rooms or building, the suit said.
The two-count suit claims negligence and loss of consortium. The suit seeks more than $100,000 in damages and court costs.
A spokesperson for the Harvey House could not be reached for comment.
