Michael L. Listy, 31, of the 1000 block of S. Second St., was charged with six counts of criminal sexual assault and six counts of aggravated criminal sexual assault, according to a release from St. Charles police.
Assoc. Judge James Hallock ordered Listy held on $500,000 bond during a Thursday hearing, according to the Kane County state's attorney's office.
If Listy posts the 10 percent needed, he must have no contact with the victim, he cannot be within 150 feet of her residence and he must surrender all firearms, according the state's attorney's office.
At 3:20 a.m. Wednesday police responded to a 911 call reporting a sexual assault in progress in the 1000 block of Second Street, according to the release.
The victim had the "presence of mind'' to call 911 and set the phone down so that dispatchers could actually hear what was taking place without her saying anything, and trace the call to that address, according to St. Charles police spokesman Paul McCurtain.
Officers got there about three minutes officers later and found Listy, who had allegedly assaulted the female babysitter he had hired to look after his 10-month old baby who was upstairs sleeping, according to McCurtain. No one else was home.
The child was not hurt, McCurtain said. The child's mother was contacted and she took custody of the baby, according to McCurtain.
Listy was taken into custody without incident. The 24-year-old babysitter was taken to Delnor-Community Hospital in Geneva and her injuries were not considered life threatening, the release said.
McCurtain said Listy does not have a criminal history.
Listy will appear in court next on Dec. 9 at 9 a.m. in courtroom 311 before Assoc. Judge Allen M. Anderson.
