When a patrol officer arrived at the 12-year-old victim's home, he noticed what appeared to be bruising on her neck, which she told him were actually "hickeys" given by Horijuela.
Police located Horijuela and placed him under arrest on May 29, at that time charging him with battery and harassment by telephone.
Shortly after Horijuela's arrest, the victim admitted to her school social worker that Horijuela had been sexually assaulting her. The two initially met because the victim's school bus dropped her off in front of Horijuela's building.
Horijuela befriended the victim and obtained her phone number. He eventually convinced the victim to regularly meet him in a stairwell of his apartment building after her parents were asleep
Between April and late May, the two met at this location, and Horijuela began sexually assaulting her.
