Mother Alleges Cover-Up In Fatal Shooting Of Son During 2011 Traffic Stop
(CBS) --A mother, whose son was shot and killed by Chicago police four years ago is again calling for charges against the officers involved.
As CBS 2's Mai Martinez reports the woman is also accusing the police department and the city of covering up his murder.
"I knew they was lying to me," says Gloria Pinex about the two Chicago police officers involved in the January 2011 shooting death of her son, Darius Pinex.
The officers said they stopped Pinex because the car he was driving matched the description of a vehicle police were looking for, and shot him only after he tried to run them over.
But earlier this year, that account was called into question during a wrongful death lawsuit when it was disclosed that the radio call the officers said they heard went out in a different police district.
"They pulled him over unjustly and murdered him unjustly and then lied," Pinex said. "They had no probable cause for pulling his car over."
In court, a lawyer representing the city of Chicago acknowledged he was aware the recording existed, but it's not clear why he didn't share that information.
"To know that lawyers played a part in covering it up, other police officers and detectives, you know what I'm saying, played a role in covering it up," Pinex said.
The judge in the federal case called for an investigation of why a copy of the radio transmission wasn't provided to the plaintiffs. Pinex's mother says more needs to be done.
"Is this how the justice system works?" she said. "I didn't think so. I thought everybody had a role to play in keeping it legal and keeping it right.
"Indict the cops and fire the people that covered up my son's murder."
Pinex's family is seeking $10 million in damages. They lost the "wrongful" death lawsuit, but are hoping the judge will grant a new trial.
As for the officers involved, one resigned from the department and the other is assigned to the patrol bureau.
