John Challenger, CEO of Challenger Gray and Christmas, says the issue of legalized medical marijuana is going to be a difficult problem for employers with the approach of the January 1 date for sale of prescription cannabis
"No employer want to see that one of their employees come into work too high to do their job and that yet if that person pulls out a medical marijuana card, where do they stand?" said Challenger.
Illinois law says an employer can require a drug free work place, and Challenger says clearly an employer can fire someone for trying to take marijuana at work, but he believes the issue of employees using medically prescribed marijuana on their own time will likely end up in court.
