Passley allegedly joined his uncle, Christopher Middleton, 26, in attacking the off-duty officer, who struck Middleton's 4-year-old daughter with his motorcycle near First Avenue and Madison Street in Maywood late Saturday night.

Around 10:30 p.m. Saturday, the eight-year veteran officer was riding his motorcycle north on First Avenue, as Passley and the girl returned from a jerk chicken shop. Both were struck by the motorcycle.

Police said the officer did all he could to avoid more serious injuries, but Middleton was furious that his daughter had been struck, and attacked the officer.

Middleton was shot and killed by the officer after punching and kicking the officer.

Chicago Fraternal Order of Police spokesman Pat Camden said the man on the motorcycle announced he was a police officer. But Middleton's family insists he never knew he was attacking an off-duty cop.

"He never let anyone know that he was an officer until after he shot him," said Middleton's cousin, Cordell Haggard.

Passley has been held since the incident and is due in bond court later Tuesday.
