He's charged with drunk driving and other offenses, including driving on a revoked license.
The Yorkville man was previously convicted and sentenced to seven years in prison after a 1999 accident that killed 10-year old Candace Graham of Lockport.
The girl's mother, Constance Graham, then admitted she also was drunk when she and her daughter were driving to a White Hen Pantry just before midnight on May 4, 1999.
Higginbotham's car slammed into the passenger's side of Graham's vehicle at State and 12th streets, throwing the girl from the front seat to the rear.
