Man Charged With Taping Up Daughter, 2, Can't Go To Her Birthday Party

CHICAGO (CBS) -- A man charged with binding his daughter's hands and feet with blue painter's tape, and posting her pictures on Facebook, will not be allowed to attend her birthday party Thursday.
As WBBM Newsradio's Brandis Friedman reports, Andre Curry's daughter is turning 2. But there won't be any cake for the 21-year-old Curry, as he is waiting until next week for a Cook County judge to determine whether he can see his child.

Curry faces several charges, including aggravated battery, for allegedly binding and taping the little girl, then photographing her and posting the picture on Facebook.
"I'm leaning toward supervised visits," Judge Lawrence Flood hinted during a brief hearing Wednesday.
However, Flood said before he reached a final decision, he wants Curry to undergo a drug test.
Once he was out, officials with the Illinois Department of Children and Family Services evaluated Curry and determined that he should be able visit his daughter twice a week with supervision, Curry's attorney Zachary Hamilton said.
Curry was arrested in December when his Facebook friends from across the country reported that a controversial picture of his daughter's hands and feet bound in blue painter's tape had been posted on his Facebook page. Tape was also placed over her eyes.
"This is wut happens wen my baby hits me back," Curry allegedly wrote under the picture.
But at the hearing where his bond was reduced, Curry's family and friends contended that he didn't do anything wrong.
"He didn't do anything to harm this child. She was never hurt, never in danger. He just made a mistake," Brandi Phillips, Andre Curry's mother, told reporters last month.
Currently, Curry cannot have contact with his daughter, nor with the girl's mother. He is also obligated to cooperate with investigators from the state's child-welfare agency.
The baby's mother, Yesmin Doss, said last month she doesn't believe Curry poses a threat to their child.
The posting elicited angry comments from Internet users and prompted a police investigation. Prosecutors say Curry used duct tape to restrain the girl, but Curry's attorney says it was painter's tape.
