Earlier this week, the high court rejected the former Bolingbrook police sergeant's appeal of an earlier ruling keeping him in jail.
Defense lawyer Joseph "Shark" Lopez would not comment on the ruling because it was issued under seal, but he confirmed that he plans to petition a federal court for Peterson's release next week.
Peterson is charged with the murder of his third wife, Kathleen Savio, whose body was found in a dry bathtub in March 2004. Her death was originally ruled an accident, but was reclassified as a homicide after Peterson's fourth wife, Stacy, disappeared in 2007.
The former Bolingbrook police sergeant has denied any wrongdoing.
Peterson has been jailed since May 2009. His trial was delayed in July, as Will County State's Attorney James Glasgow appeals since-retired Judge Alexander White's ruling regarding which statements will be allowed into evidence under the hearsay exception being used in the case.
