Boy Charged In Evanston School Sex Incident
EVANSTON, Ill. (CBS) - A 14-year-old Evanston Township High School student initially said an older boy had raped her in school, but prosecutors decided not to charge the boy involved with a felony because the sex turned out to be "in part, consensual."
The boy, 17, was still charged with misdemeanor criminal sexual abuse, since the girl was only 14, Evanston police said.
Police came to Township High School, 1600 Dodge Ave., on Tuesday and interviewed the girl, who told them a the boy forced her to have sex in a third floor restroom at the school, a news release said.
Investigators talked to both parties and obtained video surveillance footage. After conducting interviews and analyzing the footage, investigators determined that certain inconsistencies existed with the girl's original statement, the release said.
When confronted, the female victim recanted some of her original statement, indicating that the sex had been, in part, consensual, the release said. There was no clarification as to what "in part, consensual" means.
Investigators contacted the Cook County State's Attorney's office, and the facts of the case were given.
No felony charges were filed because of the inconsistencies in the victim's statement, which did not support her allegation that the sex was forced, the release said.
