Unlicensed NH Day Care Owner Drunk While Caring For Child, Police Say

LONDONDERRY, N.H. (CBS) -- The owner of a New Hampshire day care is accused of endangering a child after police say she was drunk on the job.

According to investigators, Lois Ann Mirbach had been drinking and fell asleep while caring for a 3-year-old boy on March 7. Bus drivers tried to drop off other kids that morning but Mirbach never came to the door.

Mirbach owns the "Adventures in Learning" child care center, which she ran out of her home in Londonderry.

"The officer spoke to Lois. She was emotionally upset and the officers detected the odor of an alcoholic beverage coming from her," said Det. Chris Olson.

According to the police report from the incident, Mirbach had speech that was described as "tough" and "slurred."

Investigators say Mirbach was still operating the day care without a valid license, which was revoked in 2013 for safety violations.

Past violations included the presence of knives at the facility, toxic materials within reach of children and having a yard that was not fenced in.

Mirbarch was previously fined $1,000 after a 20-month old child darted into traffic and was nearly struck by a pickup truck.

Mirbach was arrested and released on bail. She is due back in court in April.
