Tsarnaev Attorneys Request Hearing For Law Enforcement "Leaks"
BOSTON (CBS) - Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev want a judge to hold a hearing over "leaks" and public comments made by law enforcement. They say the information could hurt Tsarnaev's chance at a fair trial.
Defense attorneys point to several media reports, including an FBI interview with Scott Pelley on "60 Minutes." Tsarnaev's attorneys say investigators revealed too much information and showed emotion which could impact the case.
They pointed to a statement from former Special Agent in charge Richard DesLauriers regarding Tsarnaev's demeanor in court. "He would glance over his right shoulder back to relatives and smile and smirk at them," DesLauriers said. "And I found that absolutely galling and I found that reprehensible."
Tsarnaev's attorneys say their client didn't smirk and that he suffered injuries during a gunfight in the Watertown boat that affect his facial expressions.
They also take issue with Stephanie Douglas, the D.C. based Executive Assistant Director of the FBI, who described surveillance video from the bombing. "He does not do what everybody else in that video does," Douglas said in the interview with Scott Pelley. "He does not turn to his left."
They go on to say the FBI isn't allowed make comments that could affect a case.
