Sex Offender Arrested On Parole Violation Held Without Bail
BOSTON (CBS) – A Level 3 sex offender who was arrested for a parole violation in Boston was ordered held without bail Monday.
Richard Gardner served 28 years for kidnapping and raping three boys in the 1980s.
He was living with his parents in Quincy when he was found using a library computer. As a result, Gardner was summonsed for violating a city ordinance.
Gardner's probation was transferred from Norfolk to Suffolk County and he moved to a homeless shelter in Boston.
On Friday he was arrested in Boston.
During his Monday court appearance, Gardner attempted to hide his face with a black hoodie pulled over his head.
He waived extradition to Rhode Island, where he will now face charges.
The judge ordered him held without bail.
Peter Fellman, Gardner's defense attorney, spoke outside court following his client's appearance.
"He served a sentence, a long sentence. He may well serve more time. If the idea is that he lives until he's 95, dies at the adult correctional center," said Fellman.
"He has nowhere to go. If he's supposed to go to the end of Cape Cod and keep walking into the ocean, at some point we have to decide what we are doing to people that are the untouchables."
